2019 INAUGURAL COIN LOTTERY DRAW
OFFICIAL DRAW RULES

THIS DRAW IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW

1. DRAW PERIOD:

The 2019 Coin Lottery Draw (the “Draw”) begins on August 2nd, 2019 at 11:00:00 AM Eastern Time (ET) and ends on August 6th at 11:59:59 PM Eastern Time (ET) (the “Draw Period”).

2. ELIGIBILITY:

The Draw is open to all legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry. Employees, representative and agents of Volkswagen Inc. (“Sponsor”), the Canadian Premier League (“CPL”) and collectively the Canadian Soccer Business (“CSB”) and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, advertising/promotion agencies (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize.

3. HOW TO ENTER:

No purchase necessary.

1. Entry Form: During the Draw Period, you can enter the Draw by (i) downloading the CPL Centre Circle App in the Apple Store or Google Play Store (ii) login to your CPL Centre Circle account (an “Account”) using your email. If you do not have a CPL Centre Circle Account, click on the ‘Create Account’ on the login screen and provide your email address and create a password. Follow the instructions to verify your Account registration and pick a favourite club. You do not need to favourite a club to be eligible to win the draw. (iii) Once you are logged into your Account, select the Coin Lottery “Card” on the home feed of the app, and complete the entry form to be eligible to win. You will be asked to complete all the required fields including your first name, last name, phone number, address, postal code and date of birth. You may complete the entry form at any time during the Draw period for your entry to be valid. You may only use one Account to enter the Draw. Limit of one entry per person, per Account, per email address, during the Draw Period. Additional entries received from any one person, Account or email address thereafter will be void.

2. ENTRY REQUIREMENTS:

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LEGAL LIABILITY REGARDING THE USE OF YOUR ENTRY BY THE DRAW PARTIES AND THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES

 5. THE DRAW:

There will be one hundred (100) names drawn to have the chance to purchase the CPL Inaugural Season Coin retailed at $39.99. There is no prize with monetary value.

Entrants will have a period of 48 hrs from the time they are contacted to purchase the coin. Entrants do not need to purchase the coin if their name is drawn. There is a limit of one (1) coin purchase per name drawn.

Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) the Prize must be accepted as awarded and is not transferable or convertible to cash (no substitutions except at Sponsor’s option); (ii) the costs of everything not specifically stated above as it pertains to purchasing the coin are the sole responsibility of the winner including, without limitation: cost of the coin, shipping of the coin, transportation to pick up the package at the nearest post office, additional fees for delayed pick up or delivery (NOTE: winner may be required to present a valid ID if picking up said package at the post office); (iii) if the winner does not purchase the coin within 48hrs from the time they are contacted, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place; (iiii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the coin or any component thereof; and (iv) prize is subject to availability at the time and shall be made at the Sponsor’s sole and absolute discretion;

6. WINNER SELECTION:

At 12:00PM Eastern Time (ET) on August 7th (the “Draw Date”), in Toronto, Ontario, one hundred (100) names will be selected from amongst all eligible Entries submitted based on a randomized draw in accordance with these Rules (as determined by the Sponsor at its sole discretion). In the event such selected potential winners are disqualified for failing to comply with these Rules, as determined by the Sponsor at its sole discretion, the Sponsor reserves the right in its sole discretion, to draw alternate winners through a random draw from among the remaining eligible Entries submitted and received in accordance with these Rules (as determined by the Sponsor at its sole discretion).

The odds of winning depend on the number of eligible answers submitted and received in accordance with these Rules.

The Sponsor or its designated representative will make a minimum one (1) attempt to contact the winners within (1) business days of the Draw Date.  If  the potential winners cannot be contacted within one (1) business day of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to purchase the coin) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential winners from among the remaining eligible Entries submitted and received in accordance with these Rules. 

Before being declared THE CONFIRMED PRIZE winnerS, the potential Prize winners will be required to: (i) confirm compliance with these Rules; (ii) acknowledges acceptance of the draw is non-monetary and must be accepted as awarded; (iii) releases the Released Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Draw, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Draw and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor and/or the Released Parties in any manner whatsoever, including print, broadcast or the internet.  If a potential Prize winner(s) cannot (or is unwilling to) accept the Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize; right to purchase the coin) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential winners from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential winner).

7. GENERAL CONDITIONS:

ANYONE DETERMINED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

Participants in this Promotion agree to be bound by these Official Rules and agree that: (a) Sponsor, the Canadian Premier League, Canadian Soccer Business and their designees and assigns may use (unless prohibited by law) Participant’s name, voice, city/Province/Territory of residence, photographs, Essays, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification; and

Sponsor and the Canadian Premier League, Canadian Soccer Business and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation (but subject to operation of law), personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this Promotion.

The Releasees will not be liable for: (i) any failure of any website during the Draw; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, mobile devices, computer equipment or software; (iii) the failure of any Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network or mail delivery service interruptions or errors; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Draw; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, the Entry will be deemed to have been submitted by the authorized account holder of the email address provided at the time of Entry.  “Authorized account holder” is defined as the person who is assigned the email address by the email service provider responsible for the email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry.

This Draw is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Draw are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants, questions answered, profile completions and account creations.

By entering this Draw, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her answer only for the purpose of administering the Draw and in accordance with Sponsor’s privacy policy. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

In the event of any discrepancy or inconsistency between the terms and conditions of the English version of these Rules and disclosures or other statements contained in any Draw-related materials, including, but not limited to: the website and/or point of sale, television, print or online advertising; the terms and conditions of the English version of these Rules shall prevail, govern and control.

8. INTELLECTUAL PROPERTY

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Draw, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

Canadian Premier League and individual Canadian Premier League member team identifications are trademarks and copyrighted designs, and/or other forms of intellectual property of Canadian Premier League and the respective Canadian Premier League member teams. The prize is not monetary in value and only provides the winner the opportunity to privately purchase the coin that retails at $39.99 with free shipping at the expense of the winners.
