Centre Circle Analysis Permitted Usage

This Content Supply Agreement (referred to as the “Agreement“) is an agreement between (1) Perform Content Limited (incorporated and registered in England and Wales with company number 11562035) (“Perform“, “we“, “us” or “our“) and (2) you, the person who will download the Data (defined below) and use it in accordance with the terms of this Agreement (“you“, “your” or the “User”).

Please ensure that you have read the terms of this Agreement carefully. By downloading the Data, you are indicating to us that you agree to the terms of this Agreement. If you do not agree with the terms of this Agreement, you will not be permitted to have access to the Data and you should not download the Data.

In consideration of the benefits to you and us from your receiving and our providing the Data (defined below) respectively, you and we have agreed to comply with the following provisions in connection with your use of the Data.

COMMERCIAL SCHEDULE

1.    Term and termination rights

This Agreement will commence and take effect from the first date on which the Data is made available to you (“Commencement Date”) and shall continue until terminated in accordance with the terms of this Agreement.

2.    Content products and services supplied by Perform

Content marked below is referred to as the Content.  The Content together with the corresponding Product(s), Package(s) and/or Data Feed(s) together form the Service.

Perform will provide the Service in the Supplied Language(s) via the Delivery Method indicated below.

3.    Permitted usage of Content by User

The User may only utilise the Content made available by Perform in accordance with this Agreement for the following purposes:

  1. private and non-commercial use;
  2. powering the User’s own internal data analysis;
  3. use in blogs and social media posts;
  4. sharing on online forums and analytics communities;
  5. academic use; and
  6. online display.

together, this constitutes the Permitted Usage.

The User may not use the Content or the Service in any other way without Perform’s prior written approval and for the avoidance of doubt, the User is not permitted to:

(I) publish anywhere any raw metadata of the Content; or

(II) use the Content for any direct or indirect commercial use (“commercial use” includes, but is not limited to, providing the Content to a third party in exchange for a fee, allowing a third party to sell the Content in exchange for a fee, using the Content to pursue a Commercialisation Activity (defined below) or any other kind of commercial exploitation which is reasonably obvious) without Perform’s prior written approval.

4.    Credit

Whenever he or she publishes the Content anywhere, the User will: (a) display copyright notices or other source credits, disclaimers or source branding; and (b) comply as soon as practicable with any requests by Perform to alter the Content (such as withdrawing certain items or publishing  corrections).
